Kuwait Indemnity for Women Who Resign After Marriage
The Short Answer
If you are a woman working in Kuwait's private sector and you resign because of your marriage, within one year of the date of the marriage, you get the full indemnity (Article 52(d)).
The resignation cuts in Article 53 do not apply: there is no 3-year minimum and no reduction to half or two-thirds.
How Much the Full Indemnity Is
The full indemnity is 15 days' wage for each of your first 5 years, then a month's wage for each year after, capped at 18 months for monthly-paid workers (Article 51). Wage means your basic pay plus the allowances and commissions you receive regularly (Article 55).
For a wage of KWD 600 a month:
| Length of service | Resign within a year of marriage | Resign for another reason |
|---|---|---|
| 1 year | KWD 300 | Nothing |
| 2 years | KWD 600 | Nothing |
| 4 years | KWD 1,200 | KWD 600 |
| 7 years | KWD 2,700 | KWD 1,800 |
After 2 years on KWD 600, resigning within a year of your marriage pays KWD 600; an ordinary resignation pays nothing. After 7 years it is KWD 2,700 instead of KWD 1,800.
How to Resign Under This Rule
The year runs from the date of your marriage: on an open-ended contract, resigning after it has passed brings back the Article 53 shares. State in your resignation letter that you are resigning because of your marriage and give its date. On an open-ended contract the law asks for written notice of at least 3 months if you are paid monthly (Article 44); ask PAM if you want to leave sooner.
The Kuwait resignation guide covers notice and the letter, and the resignation letter tool drafts one for you.
Your Figure, and If It Is Not Paid
The Kuwait calculator has no separate marriage option: choose ‘Terminated by employer’ to see the full indemnity for your dates.
If your employer pays only a resignation share, apply to the PAM labour department. It tries to settle and, if it cannot, sends the case to the Court of First Instance within one month (Article 146). A denied claim is not heard one year after the contract ends (Article 144). The Kuwait complaint guide takes you through it.
