How to File a Labour Complaint in Qatar for Unpaid Gratuity or Wages
The Short Answer
In Qatar you file with the Ministry of Labour, which first tries to settle within 7 days. If it cannot, the dispute goes to the Labour Dispute Settlement Committee, which decides within 3 weeks of its first hearing. Your claim lapses one year after your contract ends (Art. 10), but filing with the Ministry pauses that clock.
Who Handles It
The dispute goes first to the Labour Relations Department (or the National Human Resources Development Department, as applicable) at the Ministry of Labour. If it is not settled there, it goes to the Labour Dispute Settlement Committee. The committee alone decides individual labour disputes, and courts will not accept these cases before the committee has decided them (Art. 115 bis).
How to File, Step by Step
- Ask your employer in writing first. The demand letter generator gives you a dated letter to keep as proof.
- Collect your documents. The Ministry's complaint form asks for a copy of your employment contract (in Arabic) and a copy of your ID card. Also keep your payslips or bank records and proof of how the job ended.
- Fill in the complaint form from the Ministry of Labour, set out what you are owed and file it with the Labour Disputes Department. The form asks whether you agree to refer the complaint to the Labour Dispute Settlement Committee. If you want the committee to decide your case when no settlement is reached, answer yes.
- Settlement attempt. The department has up to 7 days to settle, then gives both sides the result within the next 7 days. A settlement you accept can be enforced.
- Referral. Referral to the committee is the next legal step if no settlement is reached (Art. 115 bis). The department refers the dispute within the next 3 working days.
- The committee hearing. The committee decides within 3 weeks of its first hearing, and its decisions can be enforced immediately.
- Appeal. Either side can appeal to the Court of Appeal within 15 days of the decision. The court rules within 30 days.
Know your number before you file. The Qatar gratuity calculator applies Art. 54: at least three weeks of your last basic wage for each year of service, after one full year.
Time Limit
A claim for rights under the Labour Law or your contract lapses when one year has passed from the date the contract ended (Art. 10). Filing a request to settle the dispute with the Ministry pauses the legal time limit while the dispute is dealt with (Art. 115 bis). Do not wait for the last weeks of the year.
Fees
Worker claims under the Labour Law are exempt from judicial fees (Art. 10) and are fast-tracked. No separate fee for filing the Ministry form is published.
If Your Employer Ignores It
The route does not depend on the employer agreeing. An unsettled dispute is referred to the committee, which decides it, and its decisions carry immediate enforcement. If either side disagrees, the appeal goes to the Court of Appeal within 15 days.
Your employer may deduct money you owe it from your gratuity (Art. 54). The gratuity is lost only if you were dismissed without notice for one of the grounds listed in Art. 61, such as forged documents or absence without a valid reason for more than 7 consecutive days or 15 separate days in a year. Resigning does not reduce it. Read the complete Qatar gratuity guide and check your payment with the settlement checker.
