How to Resign in Oman: Notice, Gratuity and Final Pay
The Short Answer
To resign in Oman, give your employer written notice of 30 days if you are paid a monthly wage, or 15 days if you are not, unless your contract sets a longer period (Labour Law, Royal Decree 53/2023, Art. 38). If you do not serve it, you owe compensation equal to the notice period, based on your final gross wage.
Resigning does not cut your gratuity. It is at least one month's basic wage for each year of service, paid when the employment ends (Art. 61).

Steps to Resign Properly
Article 38 describes ending the contract at any time "based on a legitimate reason". The translation does not define that phrase. If you are unsure, ask the Ministry of Labour. The Ministry's e-services list resignation requests, so ask whether you need to file one for your case.
Article 39 gives workers 10 paid hours a week to look for new work during the notice period. Check with the Ministry whether it applies when you are the one resigning.
Fixed-term contracts must state the notice a party gives if it does not want to renew. When your employer is the one not renewing, its notice to you must be at least a month (Art. 36(5)).
Resigning During Probation
Probation is at most 3 months for workers on a monthly wage and 2 months for others, and can be used once. Either side can end the contract during probation by giving the other at least 7 days' notice (Art. 37). Probation counts towards your service if you complete it successfully.
What Happens to Your Gratuity
Oman has no resignation reduction. The gratuity is at least one month's final basic wage for each year of service, with part years paid pro rata, due when the employment relationship ends (Art. 61). The article applies to workers not covered by the Social Protection Law, and only until the savings system under that law starts, so ask the Ministry how it applies if you are covered by it.
Example at OMR 600 a month basic, service that began after the law came into force on 31 July 2023:
| Service | If you resign | If your employer ends the contract |
|---|---|---|
| 1 year | OMR 600 | OMR 600 |
| 2 years | OMR 1,200 | OMR 1,200 |
The amounts match, because resigning makes no difference. For service that began earlier, the Oman gratuity calculator handles the change at the end of July 2023. Enter your own dates there.
Leaving Without Notice and Keeping Your Rights
You may leave without serving notice, or before a fixed term ends, and keep all your rights including gratuity (Art. 41), in these cases:
- Your employer used fraud at hiring.
- Your employer has not paid your wage for more than 2 consecutive months, or has not met a basic obligation.
- An immoral act is committed against you.
- You are assaulted.
- There is serious danger at work.
Read Article 41 for the exact conditions before you rely on it. In other cases, leaving without notice means paying the notice compensation.
Staying away without a reason is risky. Your employer can dismiss you without gratuity in the cases listed in Article 40, which include being absent for more than 7 consecutive days or 10 non-consecutive days (the second is after a written warning).
Final Pay and What to Do If It Is Late
Ask the Ministry of Labour when your final pay is due. If you are not paid what you are owed:
- Apply to the Ministry first. Courts do not accept a case that was filed directly without a settlement application (Art. 9). The Ministry has 30 days to settle, and if that fails it refers the case to court within 7 days of the last settlement session.
- Mind the deadline. Rights lapse 1 year after the date each one fell due (Art. 9).
- If you are dismissed, complain within 30 days of being told (Art. 10).
- Online: the Ministry's e-service for individual labour complaints takes civil ID or PKI login, or passport and visa details.
- No court fees for worker claims (Art. 13).
